One-to-One Consent Rule Might Not Proceed as Planned
An oral argument made by IMC in their challenge of the FCC’s one-to-one consent rule has some industry experts doubting that the rule will go into place on January 27 in its current form. Eric Troutman of Troutman Amin stated that he believes aspects of the current ruling are going to be struck down. Troutman notes, “I think there is a high likelihood logically and topically related standard is dead. But the Court seems to be inclined to permit implementation that requires express ‘one-to-one’ consent check boxes, perhaps with the modification to allow affiliates of brands to be included.” Something tells me that there will still be plenty to be deciphered come April!

Open Enrollment: FTC Puts Healthcare Lead Gen Industry on Notice
The FTC is cracking down on the healthcare lead generation industry, sending warning letters to 21 companies during the ongoing open enrollment period. The letters, issued December 10, address potentially illegal practices related to unfair or deceptive claims. “It is critical for consumers’ health and financial well-being that marketers of health plans be honest about the plans they and their partners are offering,” said FTC lawyer Samuel Levine, Director of the FTC’s Bureau of Consumer Protection.
